IMPORTANT NOTICE:
The Property known as 37 Millyard, Unit 14-204, Amesbury, Massachusetts (the "Property”) is encumbered by an affordable housing restriction enforceable under M.G.L. c. 184, § 32, whose terms are contained in a Housing Stabilization Fund Deed Developer Loan for Homeownership Project Deed Rider (the "HSF Deed Rider”) attached to the deed from Carriage Lofts, LLC to Sara-Beth Kevorkian, recorded in Essex South Registry of Deeds, Book 23911, Page 511. The purchaser of the Property will take title subject to the terms of the affordable housing restriction set forth in the HSF Deed Rider and shall be required, as a condition of purchase, to execute a new deed rider incorporating the terms of the HSF Deed Rider.
Potential purchasers should be aware of three (3) pertinent terms of the restriction:
1)
The Property is subject to a resale price restriction and can only be resold at an affordable price calculated by the Department of Housing and Community Development ("DHCD)” or the City of Amesbury (“City”). This will affect the value of the purchaser’s equity in the Property which will be lower compared to the potential equity value in an unencumbered property sold at the same price.
2)
The Property can only be resold by the purchaser to an income eligible purchaser determined and qualified by DHCD and the City; and
3)
All mortgages, including any mortgage granted in connection with the transfer of the Property pursuant to this sale or any later refinancing, or other encumbrances on the Property must be approved with prior written consent by DHCD and the City.
All parties are on notice that the foreclosure auction will be conducted subject to and in accordance with the terms and provisions of the above referenced restriction.

The following terms are believed to be standard in the auction industry. Terms of sale for each individual auction will vary and the documents signed by the successful bidder at any auction shall supercede and take precedence over all other information including, but not limited to, the terms stated below.

  1. All prospective Buyers are required to register in order to Bid and to obtain a Bid Number.
  2. The Property Auction sale is not contingent on the Buyer obtaining financing, nor conditional upon inspection, and will not be extended for any purposes whatsoever.
  3. If you are a successful bidder, a non-refundable deposit of $10,000 will be due and payable at the conclusion of the Auction in the form of certified check, money order, or bank draft. The money will be held in a non-interest bearing account. At the end of the Auction, the successful Bidder will immediately enter into a Real Estate Purchase Contract, and be bound to the Terms & Conditions as set forth in the Purchase Contract. Successful bidders who subsequently fail to close the sale for any and all reasons will be required to release their entire deposit to the Seller as liquidated damages.
  4. All Property(s) is being sold "AS IS" condition without any representations or warranties of any kind. Bidders are encouraged to review all Property details, zoning restrictions, compliance certificate, inspection reports, and any other information prior to attending the Auction.
  5. All sales are final.
  6. The Auction sale will begin promptly at the Property location at the appointed date and time, unless a condition prevents such a sale to take place, in which case the Auctioneer will make a decision on where and when.
  7. Descriptions made by the Auction Company are made as accurately as possible in its website and advertisements, and are provided for information purposes only and should be verified by the Bidder. The Auction Company, the Designated Brokers, Seller or their Agents cannot be held liable for any errors or omissions whatsoever.
  8. The Auction Company reserves the right to deny any person admittance to, or expel any person from the Auction premises, or to withdraw any or all Property(s), or to change the Terms & Conditions, or to reopen bidding on the Property, or may designate one of the Bidders as the successful Bidder, at any time prior to or during the course of the Auction, without just cause.
  9. Bidders acknowledge that they are on the Sale site at their own risk. No person shall have any claims against the Auction Company, its staff and representatives, including its Agents for any injuries sustained or for any damages to or loss of property which may occur.
  10. In the case of dispute, the Auctioneer's decision shall be final.
